This document details the Terms and Conditions that govern your use of thetankdoctor.com.au and by using it you acknowledge that you have read these Terms and Conditions and agree to be bound by them once you commence using the website. Limitation of Liability

Under no circumstances shall we be liable for any indirect, special, incidental or consequential damages and to the extent permitted by law and we do not accept any liability for any damage or injury caused by the use or misuse or incorrect installation of products purchased from us.

For the avoidance of doubt our liability is limited to the replacement or repair of the goods, the supply of equivalent goods, the cost of replacing or repairing the goods or the cost of obtaining equivalent goods.

All content on our website including but not limited to logos, images, copy, text and general layout is protected by copyright and may not be used without express permission from us or any relevant third party copyright owners.

Consent to Communications from us

By placing an order with us you agree that we may collect, use, disclose, and keep Personal Information for the purposes of fulfilling your order. The use of Personal Information includes, but is not limited to, sending emails to keep you informed of the status of your order. You might also be prompted via email or phone call reminder if and when annual servicing of your rainwater filtration system and ultraviolet sterilisation system may be required.

Tankdoctor.com.au does not store any of your credit card or financial information on our servers, therefore ensuring the highest level of protection for you.

Payment & Shipping

All purchases must be paid in full prior to shipping and we reserve the right to cancel any orders in the event we suspect the payment method to be fraudulent.

When paying via Bank Deposit use your “Order Number or customer name” as the deposit identifier. If a Bank Deposit payment is not received into our account within 5 business days the order will be cancelled.

While we make every effort to deliver all items to you quickly we are not responsible for delays caused by Australia Post or other couriers we may use.

We make all efforts to ensure that goods are well packaged so they arrive undamaged. Please contact our customer service team if you have any delivery problems or if the package has been damaged in transit.

All pre-assembled filtration systems are flushed with fresh water and pressure tested to 100 psi before shipment to ensure the highest level of quality and performance. This process takes 24-48 hours to complete prior to product packaging and shipping.

Stock Availability

All items listed ‘In Stock’ on our website are available for immediate purchase. Occasionally may be listed as ‘Out of Stock’ if in high demand and sold out. Please contact us to register interest in the product and we notify you as soon as the item is available.

Warranty

The Tank Doctor warrants each new Product to be free from defects in material and workmanship for a period of 1 year from the date of retail sale established by the date of the original invoice.

The Tank Doctor warrants the filter system support frame from structural faults for a period of 5-years from the date of retail sale established by the date of the original invoice.

The Tank Doctor is a reseller of Viqua UV systems. All UV components are covered by Viqua’s warranty terms and conditions supplied with the Product.

The Tank Doctor’s obligation under this Warranty is limited to The Tank Doctor’s own option, to either repair or replace the Product, once The Tank Doctor has deemed that the Product is defective.

This Warranty applies only to the original retail purchaser of the Product.

All replaced or exchanged parts taken out under this warranty become the property of The Tank Doctor.

This Warranty is subject to the Product being properly installed, maintained, being used for its intended purpose and operated strictly in accordance with The Tank Doctor’s recommendations.

This Warranty does not cover the normal wear and tear of the Product, or damage caused by misuse, abuse or vandalism.

This Warranty does not extend to a Product that has been modified in any way unless with The Tank Doctor’s express consent.

The Warranty does not cover any malfunction or failure resulting from neglect, use of unauthorised parts and accessories or use with higher water pressure than indicated on the Product.

The Warranty does not cover any damage caused from water leaks from parts such as O-rings and seals that may have been incorrectly fitted at the time of installation or when the system has been serviced.

The Warranty does not extend to damage caused by rain, fire, earthquake or other natural causes or acts of nature.

It is expressly agreed that this shall be the sole and exclusive remedy of the Buyer, and under no circumstances shall The Tank Doctor be liable for any costs, loss, expense, damages, special damages, incidental damages or consequential damages arising directly or indirectly from the design, manufacture, sale, use or repair of the Product whether based upon warranty, contract, tort or strict liability.

 

ACCEPTANCE AND CLAIMS

Acceptance of the Products shall be deemed for all purposes to have taken place at the expiration of seven (7) days from the date of each delivery.

This limited Warranty is void if the Product under Warranty is presented without the said original invoice.

RIGHTS FORFEITED

The buyer forfeits any right or claim against The Tank Doctor if:

  1. The System damage results from water hammer, freezing, rain, neglect or is not installed by a licensed plumber in accordance with the installation plan.
  2. The System is operated with a water temperature higher than 38° Celsius.
  3. The System is subject to water pressure that exceeds the maximum recommended pressure.
  4. The System is not installed with an Australian Standards approved Pressure Limiting and Dual Check Valve if connected to mains water supply.
  5. The System has been found to be tampered with or if the goods have not been operated or maintained strictly in accordance with The Tank Doctor’s recommendations.
  6. The incorrect system is installed in direct weather conditions when advertised as ‘Indoor Installation Only’.
  7. All filtration systems sold by The Tank Doctor must be installed by a licensed plumber and must comply with local plumbing standards and regulations in the state or territory of system installation. The Tank Doctor will not recognise any system faults or plumbing leaks due to incorrect self-installation by the purchaser.

Returns

If any of the products purchased are faulty and do not work as expected when installed, please contact us to arrange to have the item returned for inspection within 7-days of purchase. We will not be able to refund or exchange faulty or incorrectly ordered items until they are returned in their original packaging, inspected and tested. It is at our discretion to offer a refund for items if the customer simply changes their mind.

  • For incorrectly supplied or damaged items, original and return shipping fees will be covered by The Tank Doctor. Exchange items return freight must be paid by the customer.
  • Please return within 7- days of successfully receiving your item. Return items with all packaging – include all product tags, labels & original packaging.
  • The Tank Doctor will process all returns and exchanges within two (2) working days of receiving the returned goods back.
  • For warranties, please return within the products warranty period commencing from the date of successful receipt.
  • Warranties will be processed by our customer service team within two (2) working days. The time to complete a warranty claim will vary depending on the relevant supplier.
  • Repair or replacement of any components will be at The Tank Doctor’s own cost, however:
  • a) All cost and expenses related to transport of (parts of) products from Purchaser’s site to The Tank Doctor’s workshop as well as any costs and expenses for dismounting and mounting and de-/re-installation shall be at the Purchaser’s cost.
  • b) All cost and expenses related to transport of (parts of) products from The Tank Doctor’s workshop back to Purchaser’s site shall be at The Tank Doctor’s cost.

Refunds

  • All refunds will be processed within two (2) working days of approval.
    • Refunds can only be made back to the payment method used for your order.
    • Refunds of items purchased on sale or at a discounted rate will only ever be refunded at the rate purchased.
    • Please allow up to five (5) days after The Tank Doctor has completed your refund for your financial institution to take receipt of the refund into your account.

GRUNDFOS PRESSURE PUMP

  1. GRUNDFOS warrants that the products are free from defects. A product is defective if it is not delivered in accordance with the agreement of the parties due to faulty material, design or workmanship.

Not covered by the warranty is damage due to such events as ordinary wear and tear; modifications, alterations or repair of the product undertaken by the Purchaser or a third party; failure to follow GRUNDFOS’ instructions (whether oral or in writing); installation, commissioning, operation (e.g. use of the product outside its specifications) or maintenance not in accordance with GRUNDFOS installation or service manual; use of faulty or inadequate ancillary equipment in conjunction with the product; the application of spare parts of poor quality (excluding the application of any GRUNDFOS original spare parts); accidental or wilful damage or misuse of the product by Purchaser or third party (not acting on GRUNDFOS’ behalf); Purchaser/end user’s or its own product’s non-compliance with applicable law and regulation; improper supply voltage or a fluctuation (either up or down) of the power supply specifications or characteristics thereof (including for example the loss of supply of any phases); electrical fusion, electronic drive controls or motor protection equipment; lightning strike; insufficient liquid to enable the Product(s) to perform; cavitation; corrosive action or damage caused by water quality conditions which are outside the parameters of the installed Product including but not limited to, excessive particles or solids, salinity, conductivity, electrolytic action, hazardous or caustic liquids, PH levels, liquid temperature beyond the products’ recommended range, and Purchaser’s or its own product’s non-compliance with applicable law and regulation.

  1. The terms of this warranty policy may be inconsistent with the warranty statement in the product manual. To the extent of any inconsistency, the terms of this warranty shall prevail.

WARRANTY PERIOD

  1. This is a limited manufacturer’s warranty of 24 (twenty-four) months from the date of purchase.
  2. In case of remedy of defects, the warranty period related to the product as such remains the same after remedy, however if part of a product is repaired or replaced, the warranty period concerning such repaired/replacement parts is 12 (twelve) months from the date of repair or replacement; and b) if the whole product as such (e.g. a pump) is replaced, a new warranty period of 24 (twenty-four) months from the date of replacement.

For Services, the Purchaser must notify The Tank Doctor no later than 24 months from the performance of the Services (the “Warranty Notification Period”).

REMEDY OF DEFECTS

  1. To make a claim, under this warranty:
  • by phoning 1300 651 608, or
  • via email to info@tankdoctor.com.au, or
  • in writing via posted mail to: The Tank Doctor, Po Box 3018, Aberfoyle Park  SA  5159.

In all cases, the notice shall include a description of the problem, product number, serial number (if applicable), all listed details on the pump data plate, a date of purchase and a valid proof of purchase, photos of the product and installation, as well as any other information as requested by The Tank Doctor to enable accurate product identification, assessment, and data recording.

The product may not be disassembled prior to remedy. Any failure to comply herewith will render the warranty null and void.
